Navigating compliance as a landlord in the UK requires keeping up with evolving legislation and requirements. This guide covers the latest rules to help landlords ensure their properties meet legal standards.

1. Energy Performance Certificates (EPC)

The government recently scrapped its plans to raise the minimum EPC requirement for rental properties to "C" by 2025 for new tenancies and 2028 for all rentals. Currently, landlords must achieve a minimum EPC rating of "E" to let a property. The change was announced due to concerns over potential rent increases affecting tenants.

    • Validity: EPCs remain valid for 10 years unless significant property changes occur.
    • Penalties: Fines for non-compliance can reach £5,000.
    • Voluntary Upgrades: While upgrades to EPC "C" are not mandatory, they can improve property value and reduce energy bills.

2. Gas and Electrical Safety

  • Gas Safety: Landlords must conduct annual checks using Gas Safe-registered engineers and provide tenants with the latest certificate.
  • Electrical Safety: Electrical Installation Condition Reports (EICRs) must be renewed every five years and shared with tenants at tenancy commencement.

3. Fire and Carbon Monoxide Safety

Landlords are required to:

  • Install smoke alarms on every storey of the property.
  • Fit carbon monoxide alarms in rooms containing combustion appliances (e.g., gas boilers or wood burners). Alarms must be tested at the start of tenancies.​

4. Tenancy Deposit Protection

Deposits must be secured in one of three government-approved schemes:

  • Deposit Protection Service (DPS)
  • MyDeposits
  • Tenancy Deposit Scheme (TDS)

5. Licensing Requirements

Certain properties, particularly Houses in Multiple Occupation (HMOs), require specific licenses from local councils. In addition, some councils operate selective licensing schemes for properties in specific areas. Check with your local authority for details.


6. Fitness for Human Habitation

Under the Homes (Fitness for Human Habitation) Act 2018, landlords must ensure properties are safe and free from hazards like damp or structural issues. Non-compliance can lead to legal action from tenants.

7. Right to Rent Checks

Landlords must verify tenants' right to rent in the UK through original documents or the Home Office’s online checking service. Non-compliance can result in fines.

8. Upcoming Changes: The Renters' Reform Bill

  • End of Section 21 Evictions: Abolishing no-fault evictions.
